No in-state tuition for Kansas’ undocumented students

KANSAS CITY, Kan. — A federal court in Kansas granted the federal government and Kansas’s consent judgment holding a state law is preempted by federal law because it gives in-state tuition to some unlawfully present aliens based on Kansas high school attendance without making the same benefit available to out-of-state U.S. citizens. Motions to intervene are denied as futile and the governor’s motion to dismiss as moot.
